Legal Question in Family Law in Pennsylvania

I have just recently moved out of my moms house in California. I was living with a friend in CA for about three weeks, then I moved to Pennsylvania with my grandmother. I am looking into the emancipation process because my mom still has legal guardianship over me and I would like to move back to CA and live on my own. I have not been living with her since October 31st. I also have a job. I know that these are just two requirements of emancipation. What else would I need to have my case looked at and approved? Once I go to court, does she need to be there? Also, when and if this is approved am I able to move to California? I am sixteen years old.

Well you meet one of my requirements you can spell emancipation, that said I am not a judge so that doesn't help you much.

I see an issue as to getting emancipated in Pennsylvania, you may not have lived here long enough to give the Pennsylvania courts personal jurisdiction. In custody matters you would have to have lived in Pennsylvania for 6 months. Not sure that applies here but it might.

An alternative would be to see if you can be placed in your grandmother's custody. That would be an issue for the California courts. However, if your mom agrees then your custody could be given to grandmother. Could you then go back to live in California on your own? That would be up to you and grandmother.

While you may be self supporting the courts like to see that you at least finish your education through high school.
