Recovered alcoholic with primary custody - grandparent issues

I am the father of a six-year-old boy with primay physical custody (mother moved out-of-state). When I was younger (about 7 years ago) I had a bad drinking problem. Last month I 'fell off the wagon' and drank. My son`s grandmother (on his mother`s side) found out and has been keeping my son at her house with her. I have been sober for 2 weeks since and am not drinking and am attending AA meetings. Legally, what right does she have to keep him, and what can I do?

Without seeing your custody order it would be hard to give you a definite answer. Other than the grandmother having a right to partial custody how did she take custody of the children? Under what court order does she have the right to become the custodial "parent"?

As you can see I have more questions than answers.

Generally the only person to be able to petition the courts to challenge your primary custody is mom.
