Legal Question in Family Law in Pennsylvania

relocation

my children are 14 and 12, they finally saw the judge and told him they no longer want to see their father. They don't have to anymore. I have primary physical custody, he has partial physical custody. he has appealed the judges decision. i need to relocate to another state, i cannot find employment or afford a place for me and my children. i was told that i can leave, my court order says nothing about not being able to leave the state. it was said it has something to do with the grover hearing. could you please tell me if i may leave.

It's the Gruber Factors. It applies to interstate and some in state relocations. Its really the best interest standard as applied to the move.

It takes into account whether the move will make the moving parent and there for the children better off. It looks at how well the parent who is moving can accommodate partial custody and the like.

Those are but two of the things the court will look at on whether the move might trigger a custody modification.

Add to this the wises of the children. There the issue are they of the maturity to decide whether seeing dad is something they want to do.

Custody matters tend to been fact driven so I don't think I have enough facts here.
