Legal Question in Family Law in Pennsylvania
How to request to the court to order a psychiatric evaluation for bipolar disorder / schyzophrenia /mental illness on the father that has been physically abusive and continues to be mentally / emotionally abusive to the children. Making threatening phone calls and also reinforcing that the physical abuse, choking, slapping, punching in the face "was necessary" to the child. The whole family, brother has the condition and his wife divorced him,the sister has the condition and was involuntarilly admited to a psych ward. Family of ex continues to harrass and make threatening calls in my work place.Father lives in another state.
1 Answer from Attorneys
If you would like a psyc eval for the father, I would suggest that you let your attorney know that you would like to request an evaluation. Your attorney can then make the appropriate request.
If you don't have an attorney, I would suggest that you retain one. Its hard to say how you would request an eval without knowing where you are in the process. Evaluations are generally requested at the conciliation conference, but if that has already passed, there may be other options, but it would like require a filing in court.
If you don't have an attorney and can't afford one, I would suggest that you contact your local legal aid. If you would like to retain a lawyer, feel free to contact me. It looks like you are in Cambria County and my firm does accept cases in that county.
Either way, you really need to retain a lawyer if you haven't already. Your odds of success are drastically lower without a lawyer, particularly if he has one..
