Legal Question in Family Law in Pennsylvania

Requirements for Child Visitation

What are the requirements... What must the father have or put in place for any visitation to be granted?

For example: Should a 4-yr old daughter have her own bed?

The father of my child is, in effect, HOMELESS! (living w/his adult daughter). During a PFA hearing,he stated ''My parents will let me live w/them where she will have her own room''. The judge granted him visitation EVERY weekend!! She has had 3 visits there now and SLEEPS WITH HIM in his parents bed! Is this appropriate? Also, he has anger mgmt issues and there's been fighting going on there (which is why I removed him from our home in the first place). And advise will be greatly appreciated. Anjela

Re: Requirements for Child Visitation

He should at least have a separate bed for the child. Custody provisions in PFAs are usually only tempprary-you should file a separate custody action and deal with the issue of his living arrangement there. In the alternative, you could file to modify the PFA-however, more than likely they will tell you that as it is a custody issue, you have to deal with it that way. Please contact me if you would like to discuss or schedule an appointment at a mutually convenient time and at one of my several locations.
