Responsible?

I plan on leaving my husband,we have no children. We own a home,and both our names are on the loan. Legally, am I responsible for half of the house payment and half of our debt, if I do not live there? Thank you for your help!

You asked if you are responsible for your half of a home loan even if you are not living there.

The good news is that no, you are not responsible for half of the home loan.

The bad news is that you are responsible for the entire home loan whether you are living there or not. The bank doesn't care where the money comes from, but both parties on a home loan are responsible for 100% of the debt. In other words, if one party goes bankrupt then the other party is still on the hook for the entire loan amount.
