I have retained a lawyer for my divorce. I have decided to work it out with my wife. Am I able to get the retained fee back?

You hae a lawyer and should direct questions to him or her. The answer is "it depends." It depends on what is in your written fee agreement with the lawyer. True retainers generally are not refundable. Most cases do not involve true retainers but funds against which the lawyer will be. Excess funds that are not used by the attorney are to be returned to the client. The lawyer probably met with you, so you are not going to get the whole retainer back, but you should get part of it back.

If you do not get it refunded, demand that your attorney provide you with a written accounting of what they claim the attorney claims he or she is entitled to keep. Put this in writing as well as any written response. Then contact the state bar. The bar has fee dispute committees. .
