what rights do I have if i seperate from my husband. we have a house he won't pay have of the

mortgage

Given that both you names are on the mortgage and on the promissory note not paying the mortgage will not be in either parties best interests. Even a mortgage delinquency would be a bad thing to have on your credit report.

As the house is most likely the largest marital asset assuming there is you have some equity built up hanging on to it is another reason to keep the mortgage current.

There are a number of facts you didn't state. Such as do you have children, how long you've been married, what is owed on the house and what its current value is. These are very important fact to know in determining what legal steps you need to take.
