Legal Question in Family Law in Pennsylvania
rights as a sister
Hi,
I have a sister who is 16 years old almost 17 in a month or so... she is very unstable and has recently gotten into some trouble.... her father , my dad, lives in south carolina and she lives with her mother , my stepmom....she doesn't want to live with her mother anymore and her father is a truck driver out of town alot.... i want her to come and live with me and she has mentioned running away? anyways my question to you is that is if she told her mother and father she wanted to stay with me until the end of the school year could they forse her to go home? and is there any legal action her mother can pursue to make her do so? Would she be allowed to live with me? and can she make that decision being only 16? thank you

Re: rights as a sister
Your sister cannot make that decision on her own at the age of sixteen. Her parents could report her as a runaway, or could sue you for interference with custody.
The better approach would be to obtain the agreement of the parents, or the custodial parent, if she lives with only one. If she is presently in a dangerous situation, you may wish to file for custody.
