What are the rules for child support?

My sons exgirlfriend delivers a child tomorrow. We assume the child is his. No paternity test is planned. He offered marriage and even bought home for them. She wants nothing to do with him. She has stated she does not need a father for her baby. What are his rights? If he decides to not be involved at this time and she decides years down the road to take him to court for child support will he have to pay back child support? What will his rights be then if he is proven to be the father? What is the significance of his name on the birth certificate? What would our best approach to this situation be?

Assuming he's the dad then he has a duty to pay child support. Short of the child being adopted that duty doesn't go away. It wouldn't matter if the mom even signs a written agreement not to seek child support. Further, should mom ever apply for assistance then the state could ask that he pay child support. Also, if he wishes to be in the child's life now is the time to start. As the father of the child he has rights to custody either legal or physical or both. Legal custody can be given to either parent or jointly to both parents. He could get primary physical custody (the child lives with him) or partial physical custody (aka visitation).

Delaying the enforcement of these a really bad idea. Legal fees will be more and you may not be successful in achieving what you seek.
