If you don't feel safe, you should look into getting a protection from abuse order. You can contact the court house in your county to get information on how to obtain one. In regards to a divorce, you should contact a lawyer as soon as possible.

You can file a Protection from Abuse action in the county you are in, as well as a child support action for the 9 month old. I would also file a complaint to confirm custody. Please call for a free 1/2 hour consult.

Re: Seeking for help, legal separation or divorce

Pennsylvania provides for protection from abuse. That is a temporary order which can exclude him from the residence and prohibit any contact with you. A hearing must be held in 7-10 days. If a permanent order is entered, it can last for 18 months.

Regarding divorce, Pennsylvania is no fault so you need not show any reason for the divorce. However, absent his agreement, you must be separated 2 years to obtain a divorce decree.

I trust this answers your questions but you should speak to an experienced family practitioner as soon as possible.

I am happy to consult with you on a free initial basis. I have 15 years' experience as a family law practitioner and am a former hearing officer with the Montgomery County Domestic Relations Office.
