I have been separated from my husband for over a year, my children and I live in the house, can I have someone move in before the divorce is finalized?

Yes. You do not need a divorce court's permission to have someone move in . . . BUT if his name is also on the deed and there is no present use-and-possession order from the court, he can legally come in anytime. Of course, that would probably be an ugly scene, especially with the kids at home.

I suggest you obtain a use-and-possession order from the court first. Personally, you might also consider whether it's a good thing for your kids to have him move in so soon and before the divorce is finalized. Best of luck to you.
