Legal Question in Family Law in Pennsylvania
I am separated from my wife for 4+ yrs now. She and my daughter occupy our house that has both our names on the Deed, a first, and a second, Mortgage. Child support is court ordered and paid regularly. We are agreeable to a divorce and I have filed for an "uncontested" one, good anywhere in PA. She is hesitating to sign the papers due to concerns about her losing the house in the future. Our unofficial agreement is that she will continue to pay the primary mortgage, and I will continue to pay the Second mortgage... with her maintaining sole possesion. Is there a way I can simply "sign over" all my rights and interest in the house so that she will feel safe in signing the Divorce papers?

The best course of to make a Marital Settlement agreement. This will put your agreement in writing and it can be filed as part of the divorce. That way it con be enforced by the court.

You definitely should consult an attorney......don't try to save money on something this crucial and far-reaching...The amount you would spend to draft a marital agreement with legal guidance will far outweigh what you could lose if it is not handled properly.
