Legal Question in Family Law in Pennsylvania
settlement
I filed for divorce in june 2006, legally seperated since May of 2006, wife gets spousal support, I'm trying to move the divorce along and have made appropiate offers with no response from wife's attorny. Does a response have to be giving once an offer is made, or can wif'es attorny just ignore it. Also what else can be done to move along divorce without having to wait the 18 months.

Re: settlement
A divorce is available after 90 days after filing only if by agreement of the parties.
If one party does not agree it takes 2 years of living separate and apart to obtain a nofault divorce.
However if there are unresolved financial issues a court will not necessarily grant the divorce until they are resolved.
There are motions to file that will have a master appointed to resovle economic issues.
Hope that helps, if you need assistance contact my office.
Re: settlement
Since you only separated in 5/06, and since you filed the divorce, you may have to wait the 2 year separation, or until 5/08, to get things moving, if your wife does not want to cooperate. Under these circumstances, she cannnot be compelled to sign a Consent.
I would have to review her answer to the complaint and any counterclaim, to see if there is a way to move it forward.
