Legal Question in Family Law in Pennsylvania

signed statement

We were planning on going on vaction for a week. My boyfriend is suppose to go to court with a friend as a witness. If he would do a written statment and have it noterized. would that hold up in court?

Re: signed statement

You asked about submitting a signed statement in lieu of a court appearance.

Generally no. A notarized statement will usually not be sufficient to establish testimony. There are some exceptions that may be applicable, such as submitting an affidavit with the consent of both parties, or having a deposition done (depending on the type of matter).

I all cases the opposition has the right to question opposing witnesses. If you want to stay friends with that friend then you need to work with that person to an agreement or otherwise postpone that vacation.

Regards,

Roger
