I am a single mother (never married) in PA and am wanting to move back to IN with my son. Can I do it without the father trying to say i kidnapped him?

If you have a custody order you need to follow that in notifying dad of the move. If you don't have one then you should notify him of the move. If he doesn't go to court and object he is assumed to waive his objection. If he does object but you can prove you and hence the child is better off among other things you'll have to prove the court could let you move to Indiana.
