Legal Question in Family Law in Pennsylvania
nowhere to sleep
son and daughter-in-law apparently are going to seperate and then divorce. Problem with this is the 7 year old granddaughter. The dauughter-inlaw wants to move her and the grandchild to indiana--without the father. in the meantime the wife has kicked the husband out of the apartment, changed all utility bills to her name, changed the name of lease to the apartment to her name and says she has all the rights to kick the father out of the apartment and she has the right to keep the child. Can she kick the father out of the apartment that he pays for and has his name on the lease? She is not working so kicking him out of the apartment makes this all her bill, but nowhere for the father togo Can he keep the apartment and child and kick out the mother who seems to be having some physcological problems? This would keep the child in her school, in familiar surroundings, and with her father. The mother of the child seems to not want the father or anyone on that side of the family to see her. Is the mother allowed to take her to indiana without the father's concent--and have her not come back? What does the father have to do to keep full custody of his daughter, and how can he keep the mother from moving to indiana with the child?

Re: nowhere to sleep
The father would have to file a custody complaint in the county he resides in. This wouls grant the court original jurisdiction. The court could order the mother not to move. As to the apartment, the father could file to evict the mother if he is the leasee or vice versa. I offer free consultations.
