Legal Question in Family Law in Pennsylvania

Sole Custody

The entire family - mom, dad, sisters, brothers, etc...are planning a cruise in October 2008 and I need to get passports for my children however, my husband will not sign the passports - it is only the children he is hurting but he does not seem to care (or budge). I understand needing both signatures do to kidnapping but I am going and coming back! I have also been told that the father and his new wife will not help or do anything until I agree to their custody terms - which I could do if there were no overnights involved - the girlfriend had kicked out my son twice who was 8 years old at the time. The dad does not see them too often and when he does, it is his grandmother who wants them; he has not seen them since December 24 - nor has he called to see how they are doing in school or anything else. I cannot get him for abandonment because I think they study that law and make sure the amount of time never elapses! Me and my boys want to go on this cruise and the dad's ignorance may ruin that for us!

You asked about getting a passport for your children.

Fortunately you have sufficient time and if you move expediently you can easily have this solved.

You need to speak with your attorney or a new attorney about just how to resolve the matter.

I had a similar case a couple of years ago. Mom want to take the child to Cancun and dad didn't want the child to go.

The using the best interest of the child standard held that there was no compelling interest why the child should not be allowed to go.
