Does the sole owner of a house have to right to say who lives there?

My husband is the sole owner of the house we live in. My daughter has been living there on and off for 4 years. She has damaged his house on two different occasions, and has caused some much stress in the house that my husband (her step-father) doesnt want her back there. Visit are fine, but he doesnt want her living there. My ex says he will take me to court to make her live there. I have primary custody of her, and I dont mind if she lives with her father and just visits me. he said no that he wants 50/50 or nothing. She wants to keep going to school at the school she is at now, and that is why he wants the 50/50 custody. My daughter and myself fight all the time so it is not a good place for her to be. But my questioni s does my husband (her styep-father) have to let her live there, or does he have the right to say no?

Well the question isn't if your daughter will be allowed to live there but will you.

I've never seen a custody case where the petition is demanding not to have custody. The court is going to wonder.

The real question is can the root cause of your daughters destructive behaviour be addressed?
