Legal Question in Family Law in Pennsylvania
My ex has our son every weekend, he lives in a trailer w water not suitable for drinking, a steep driveway that you need 4wd to get up in case of snow, leaking ceiling and mold all through the house, nor a bedroom or bed for him to sleep in and sleeps on the couch , our son is 5 years old... Is this considered abuse or endangerment? Should I seek a lawyer?
1 Answer from Attorneys
I will presume that you have primary legal custody, I will further presume you are concerned about the conditions at your child's father's residence as it relates to the safety of your child. Based on these presumptions I would definitely suggest you obtain an attorney.
You have a number of options, including filing a Petition to temporarily suspend the father's visitation rights, until he he is able to get his residence in a better condition. Or you could ask the Court to Modify the coustody order, limiting the father to a few hours once or twice a week visitation pending the father getting his residence in a safer more habitable condition.
Th bottom line is your child is at risk and you need to act immediately. You can check our my website at www.DebraRaineyLaw.com
