Well her parents aren't lawyers. Because you and your ex have no order then assuming paternity has been established you do have rights. It might not seem like the right time to do it but you should file for a custody order. If the ex girlfriend is willing you can agree to what you want the custody order to say. You can probably get one fairly quickly.
