Legal Question in Family Law in Pennsylvania

my son is a 16 year old father of a nine month old girl. the mother is also a teenager, the baby resides with her and her parents. there is no court order for visitation or custody. my son picks the baby up from daycare on tuesdays and thursday and then we take her home at 8pm. he also gets her overnight one night every weekend. he wants to take the baby on vacation to florida for 1 week and the the babys mother is refusing. is it illegal if he just takes the baby anyway without her permission. we live in the state of pennsylvania. could i be charged with a crime if he does this because he is a minor even though he is her father? could he be charged with a crime? he would however make her aware of the address where we will be at and when we will return.

I highly recommend that you do not simply take the baby without an agreement although there is no custody agreement in place so technically, you could do so. What he should do is file a custody petition as soon as possible. Please feel free to contact my office. (610) 279-4300.

Why not get the custody arrangement formalized as an order. You would have to file on your son's behalf.
