I had my son for 3 years he's non verbal do I need a custody order for him to stay with me

I am not really sure what is meant by non verbal, unless that means he is mute. Regardless of that or how long he has lived with you, no order is required. However, if you are concerned that the other parent will seek to take your son, you should obtain an order to at least have the protection of the court for your custody and any exercise on the other parent�s part.
