Legal Question in Family Law in Pennsylvania
My son's dad and I recently went to a child support modification and his child support got raised. We currently use the same babysitter and on our support order it states that we each have the expense of the babysitter. He stated to our babysitter since now he has to pay me more child support that she will have to receive his expense of child care from me. Do I have to pay her his expense of child care if it states on the support order that he pays that expense on his own?

Thank you for your question. You stated that the support Order provides that, "we each have the expense of the babysitter". There is no ambiguity in the Order. It clearly states that each of you has to pay their own expense of the babysitter. It would be impossible to take that language to mean that you have to pay the father's babysitting expenses. The father's obligation for child support was raised probably because he showed an increase in his earnings and this would have nothing to do with imposing his babysitting expenses on you.
