If my spouse will not sign divorce papers how long until we are no longer legally married.

If your spouse will not voluntarily consent to a divorce and sign an affidavit saying so, you can wait two (2) years after your separation date for a non-consent divorce. Of course, if there are fault grounds for the divorce (adultery, desertion, etc.), you don't have to wait at all -- but that's an uncommon process these days and takes additional work in court at extra expense.

The bottom line, however, is that you're married until a court says you're divorced -- whether you've been separated for five minutes or for 20 years. The divorce decree from the court is what matters. Hope this helps.
