Ssi for my son

My husband maked approximately

$50,000 a year. We recently

seperated, but are not yet divorced.

My youngest of three children, was

recently diagonsed with autism and

other speech and communication

disorders. Can I apply for SSI for

him. The therapists told me it would

be horrific for me to go back to work-

he would regress more. I am living

on what my husband feels like giving

us. Is there any way his whole

salary would not be considered since

he does not live with us?

You have several issues. Social security provides disability for children under both social security disability and ssi. They are two different programs but disability is determined under the same procedure. Since you are separated you can seek child support against your husband. His income will be considered as well as your income. If you are not working you earning capacity may be considered. If because of medical reasons you must stay home with your child then this will also effect the case. I would suggest you meet with an attorney to discuss these issues.
