Legal Question in Family Law in Pennsylvania

Next step in

I am filing my own divorce and my husband and I are in agreement on all aspects of the divorce. I already filed a complaint in the local couthouse with the Prothonatary's office on March 15th. So the required 90 day waiting period is just about up. My problem is that no one will tell me what to do next. What papers need filed next and where do I go? I live in Berks County Pennsylvania.

Re: Next step in

Its not too hard but you need to file the right forms. Actually there are 2 forms you and your soon to be ex need to execute after 90 days are up:

1) An Affidavit of Consent (the form is in the rules of Civil Procedure)

2) A waiver of notice of intention to file for a decree of divorce. (again another form from the Rules of Civil Procedure.

Each of you sign both these documents.

Make 2 additional copies. File the originals with the prothonotary. The copies are for you an your soon to be ex to keep.

After you get those filed you need to file a Praecipe to Transmit the record. And 3 copies of the proposed decree. You may also need to file a divorce information sheet ask the prothonotary for a copy. You file that and in a few days assuming all the paperwork is in order you can go a pick up your divorce decree.
