Legal Question in Family Law in Pennsylvania

Step parent adoption of my 2 children

My husband and I have been married for over 4 years. I have 3 children, one is biologically his. He wants to adopt my other 2-ages 8 and 5. Neither one of my other 2 have any contact with their biological fathers. What would we have to do for this to take place. The other father's names are unfortunately on the birth certificate but neither of them has had any contact with them pretty much since birth.

Re: Step parent adoption of my 2 children

To adopt the children your husband has to file an adoption petition for the 2 children.

For the adoption to go through the biological father has to terminate his parental rights to the children. This can be done either voluntarily or involuntarily. The incentive for the biological father to terminate his rights is that its the only way he can avoid his support obligation for the children. If that does not motivate him you can file for an involuntary termination. To get his rights involuntarily terminate you will need to show that he hasn't had contact nor supported the children.
