Legal Question in Family Law in Pennsylvania

Stop Divorce Action

I filed for a divorce 2 years ago and it is still dragging on, we went to court a couple months ago but it was continued. I am now out of work and can't afford to go on with the divorce, (we are both 62 years old) we have been seperated over 2 years, neither of us intend to remarry can I stop the divorce? My attorney says the judge wouldn't allow that, I'd like a second opinion.

Re: Stop Divorce Action

When a divorce complaint is filed, followed by the usual answer and counterclaim, many claims are put before the court. Generally speaking, all have to be settled and made court orders before the case is concluded - either through a settlement agreement incorporated into an order of divorce or by a judge issuing an order following trial on the issues. The case can also be concluded by a withdrawl of all claims by petition from both individual parties through their attorneys after full disclosure and agreement. The plaintiff in a divorce case cannot unilaterally withdraw the case. Your attorney, who is familiar with the particulars of your case, is your best source of advice.

I wish you the best.
