Legal Question in Family Law in Pennsylvania

Successor Custodian

A grandmother was custodian of a minor grandchild's mutual fund account. The Grandmother died four years ago, no successor custodian was named. The child, in Phila., is now 19 years of age. How can we get the grandchild's parent named as successor custodian to give the grandchild or parent access to the money. What is the process for petitioning the court in Phila. Can it be done without an attorney?

Re: Successor Custodian

It seems that you are asking about the uniform gift to minor's act. I believe the act requires a Petition to the Court. Because of the age of the grandchild he or she can probably consent to the new custodian. You should probably consult an attorney but you may want to check the Purdons Statutes which govern these accounts which you can find in a law library.I believe they should be in the volume that regulates wills and related documents. Should you need further information you may want to consult with my office.
