Legal Question in Family Law in Pennsylvania
Support order
My husband has no income - he is a stay at home dad because our son was born with a congenital heart defect 3 years ago. He has a son from a previous relationship and the mother constantly wants money. She filed for child support and was awarded $212/month. Last we heard, she was working at Wal-Mart but was planning on quitting because she didn't like standing on her feet for 8 hrs. She may not be working at all now. My question is - how was it determined that my husband should pay $212/month when he has no income to enter the support calculation equation? According to the PA code, he should be responsible for 0% & she should be responsible for 100%. They can't have more than $800/mo in combined adjusted monthly income & the chart says that the monthly amount should be $50 split between the two of them. Again I say, how did they arrive at $212? Can I dispute this? What if she has no income either? P.S. The boy lived with us for the last 2 1/2 yrs and we never got one penny from her. This seems so unfair.
