Legal Question in Family Law in Pennsylvania

Support=Custody?

I have a seven year old child. The childs father has never paid any support and we are now battling in the courts for support to be paid. His rears are 28,000. I have full custody, with no visitation without predjuce. I need to know that if I fight for support and he trys to ammend the custody agreement, will he be granted visitation? The court does what it thinks is in the best interest of the child, but for the child to be away from the father in this case is for the best. He is abusive and has made no attempt in 7 years to contact his child. What are the chances of him getting visitation if he pursues it, or if I pursue support? There have been numerous warrents for him not paying support, he has been unemployeed for 5 years, what do I do?

Re: Support=Custody?

Support and custody are 2 separate issues. Just as paying support doesn't guarantee a favorable custody ruling neither does not paying support bar you from getting partial custody.

If he has been unemployed for 5 years how is he going to get a lawyer to fight you on custody?

Why hasn't the court ordered him to get a job?

Custody and support matters are one 2 different dockets. So if you take him to the DRO he would have to file a custody action over at the Prothonotary.
