temporary sole custody for mom, while father is in halfway house
my ex has been in prison since before my daughter was born, now he is in rehab and will soon be release to a halfway house where he has access to the community, from there he will be on parole until 2004, can i file for sole custody at least temporary to bar him from trying to contact my daughter until a hearing with family court can be set up?

Custody cases are decided based upon the best interests of the child. There are many questions in your case including whether the father has maintained contact with the child, and how much time has passed, as well as all issues bearing on character and the safety of the child. If he has not maintained any contact with the child over a long period of time you would be in a better position. However, you should be aware that it is very rarely that the courts deny visitation rights entirely.
