Trusts

My parents set up a trust for my brother (who has a learning dissability) while they were going through a devorice. Both of their names were needed to get any money out of the Trust. My mother has just past away and asked me to take her place on the Trust; however she was in the hospital and we were never able to get to anything down on paper. My consern is that my father will drain the Trust without someone keeping an eye on him. What can i do?

Re: Trusts

Trusts fall under the jurisdiction of the Orphans Court. As a trustee he has a fiduciary duty to the beneficiary of the trust. As such he would have to answer to the Orphans Court if he violated the terms of the trust.

The person who would have standing is your brother.
