Unmarried/Seperating/Own Home Together

I have been in a relationship for 17 years and co own a house with my ex fiance. I would like to move, have him take out a equity loan and pay me a fair amount for my 1/2 of the house, and I will sign off our current loan. He does not want to do this amicably. What are my options.

If you were married at common law before 2005 you have the option of divorce and division of property. If you clearly were not then you have the option of an action in partition where you ask a judge to sell the place and divide the proceeds. Because this second method will seldom bring the best return it often results in a more or less amicable settlement. I guess you are tenants in common so you also have the option of selling your interest separately. Again, you are not likely to get the best return; but if your ex doesn't care for his new potential co-owner this too could result in a more or less amicable settlement.
