Legal Question in Family Law in Pennsylvania
Unreimbursed medical?
I currently am a NCP, ordered to pay 70% of unreimbursed medical expenses for my son. My son has been on ''Concerta'', a behavioral drug, against my desires. Is a drug like this considered a ''Psychiatric or Psychological'' service? These services are not covered under the current PA guidelines. My son's mother unilaterally placed him on this drug 5 years ago. I was not aware, or included in this decision, even with Court ordered ''Shared Legal Custody''.

Re: Unreimbursed medical?
Medical expenses are generally those considered medically necessary or ordered by a physician. Because Concerta is obtained through prescription, it would be as the result of a doctor's order and diagnosis and thus most likely a medical expense.
Your question seems to be more directed toward the issue of the appropriateness of the medical treatment your son is receiving, and the welfare of the child. Shared legal custody contemplates both parents sharing in decisions regarding the child's well-being. If you have concerns in this regard, you should consult with an experienced domestic relations attorney to gain an understanding of your rights and options.
