Legal Question in Family Law in Pennsylvania

Utma

My daughter owes me money and I want to take it out of the UTMA that is set up for her. I am the custodian. She won't be 21 until Feb. 2008. I paid for her car and insurance over the years out of my own money and now I need the money. Can I do this?

Re: Utma

The short answer is No.

In re Gumpher, No. 277 MDA 2003 , SUPERIOR COURT OF PENNSYLVANIA, 2003 PA Super 493; 840 A.2d 318; 2003 Pa. Super. LEXIS 4535, December 17, 2003, Filed

OVERVIEW: Mother's liquidation of daughter's Pennsylvania Uniform Transfer to Minors Act (PUTMA) account for mother's benefit constituted a breach of mother's custodial responsibilities to daughter because PUTMA said nothing about retroactive reimbursement

Good luck to you.
