Legal Question in Family Law in Pennsylvania

Violation of Custody Order

My ex husband lives in Virginia, I live in PA. We have a court order giving me primary physical custody during the school year and he gets every other weekend. It reverses in summer, so he has them now. He just informed me that he wants to change the EOW schedule and is not meeting me in Carlisle this friday (per the order) What can I do?

Re: Violation of Custody Order

Once he follows through and fails to bring the child for your weekend visit, you have the option to file for contempt to enforce the Order. I suggest keeping a diary of events to assist you if you have to go to court. I offer free 1/2 consults, at several office locations, including one in Jenkintown.

Re: Violation of Custody Order

Assuming that this is a PA court order he would need to file for a modification of the custody. Because he did not his decision to change the terms with out your consent is a violation. The bad news is that he actually has to violate the order. Saying he will is not enough. So you probably should file you petition for contempt of custody after the first missed visit.

If you have any questions feel free to contact me. The initial consultation is free.

Re: Violation of Custody Order

My first question is, thinking of the kids, is it reasonable to change the schedule and if so can you and your ex come to an agreement?

If we can help let us know.
