May a grandparent sue a child for visitation rights to a grandchild?

Yes, grandparents have standing in Pennsylvania to sue for custody. If it is in the best interest of the child not to be in the custody of either parent and it is in the best interest of the child to be in the custody of the grandparent, the court may award custody to grandparents. This generally refers to a grandparent who have been acting as parents for an extended period of time or who has stepped into the parental role due to risk of abuse, neglect or drug abuse.
