Legal Question in Family Law in Pennsylvania

Will the court force a child to see a parent she doesn't want to see? My daughter is 15 and lives with me, and her mother is trying to force a custody agreement wherein my daughter is forced to spend time with her mother. We don't currently have a custody agreement in place. We live in Pennsylvania.

So long as there is no custody order, you do not have to send your daughter to see her mother. However, the mother does have the right to file a complaint in court and ask that the court enter an order giving her rights to visitation or custody. It is hard to say what the court would do, but the Court certainly could order visitation. If that happened, you would be required to send your daughter for visits or you risk being held in contempt of court. Given her age, the court will take her feelings into consideration, however, the court looks at many factors to determine the best interests of the child.

If she would file in court, I would highly suggest that you retain a lawyer right away.

Beyond that if mother were to file either of her parents would have to file on her behalf as mother is under 18.
