Legal Question in Medical Leave in Pennsylvania

Asked for help then told to take FMLA

I have 2 conditions that are agrivated by stress. Stress kept getting worse at work. I asked for help via change or reduction of clients. After making an costly error, which I predicted would happen, I was given a written disciplinary action. I second guessed all my work, my hands shook and I cried constantly. I told my supervisor I wanted a transfer out of the dept since I could not see this getting any better. I was going to be coached by a co-worker for 2 weeks. After 2 days she was off for 4 and I was left on my own. My FMLA papers mentioned pain but not the memory problems or the effects of stress.I also have an anxiety disorder for 20 years but I have no papers filled out. While the co-worker was off I just could not focus and was called into HR and told this and asked if there was something they could do to help. At this point I felt it was useless as I had tired already so I said no. I was then asked if I thought I could do my job. I said no and was told to take some FMLA time and they would try to find me something, but no garunetee. I just don't feel I was treated correctly. I am now at home waiting for them to set up interviews I am being forced to use my time plus these hours will come off of what FMLA I have.

You asked about Family Medical Leave Act leave.

Your situation sounds like the employer is being very considerate and helpful. (I could tell you stories...).

You should be a seeing one or ore physicians and mental health professionals. You need to determine if you conditions qualify as disabilities under the Americans with Disabilities Act and if the employer must offer accommodations under the ADA.
