Legal Question in Medical Leave in Pennsylvania
Confidentiality Violation
I was in the HR office at work to some questions answered about my FMLA and another party was present. She went to get up and leave, but turned around and sat back down. I don't know if the HR rep motioned for her to do so or not, I did not see this. The HR rep didn't even close the door. After I asked my questions, I walked out of the office and another employee was sitting no more than 10 feet away and heard what was taking place. Is this a violation of my confidentiality?

Re: Confidentiality Violation
You asked about confidentiality.
Yes, it was a violation of your confidentiality. Now slap yourself on the wrist for violating your own confidentiality.
Confidentiality and privacy is yours to maintain. If you have something confidential to discuss it is incumbent on you to do your utmost to obtain and ensure confidentiality.
When a client enters a lawyer's office with a friend or relative in tow the attorney will often ask the guest to wait in another room while the attorney and client speak. This is the way to maintain confidentiality and is the only way to maintain privilege.
Next time, get up and shut the door yourself.
