Can someone keep calling out of work one day at a time and say he is covered by family leave act.

If the reason for calling out is a "serious medical condition" as provided for by the Act, then the person can take intermittent leave, even if it is one day at a time. However, the reason must be that the time off is for a "serious medical condition", and the employer has a right to documentation of the condition by the doctor(s), and has a right to doctor's explanations for the one day off at a time leave.
