Legal Question in Medical Leave in Pennsylvania

Can you help me? I am a public school teacher who is in need of foot surgery on both of my feet. I also must respond to an anonymous complaint filed against me before the PA Standards and Practices Commission, which requires me to temporarily surrender my license until the PSPC meets on September 22, 2008.

If I take FMLA BEFORE I surrender my license, have my surgery, temporarily surrender my license, and am reinstated by the PSPC on September 22, 2008 - which is well before I will be healthy enough to return to work - does my school district have to hold my job? At no time while my license is surrendered will I be in the classroom. Moreover, I am VOLUNTARILY surrendering my license in order to fully cooperate with the investigation, which is political in nature and which I am certain will vindicate me.

PLEASE HELP ME - TIME IS OF THE ESSENCE

You asked about FMLA leave and a surrendered teaching license.

You need to hire an attorney immediately. If you are a member of a union then they can help identify an attorney with the skills you will need. If you are not a union member then you should seek an attorney who can represent you be the standards and practices commission. s/he can give you proper guidance about how to best use FMLA if appropriate.

Do not delay in engaging an attorney.
