Legal Question in Medical Leave in Pennsylvania
FMLA qualifications
Hello,
I work for a non-profit organization that I have been with for just over 2 years. I have currently been laid off from my current position and placed into another position that I am really not interested in. Additionally, I have had a lot of outside of work stress related to family situations and my own mental health. I would like to know if/how I could qualify to receive fmla compenation during this very stressful period. I thank you for your help.

Re: FMLA qualifications
No. Stress injuries are rarely compensible and only if there was some unusual work condition which provided the stimulus for the psychic response. Outside factors from family situations make clear that no injury arose out of and in the course of your employment. If you are diagnosed with a serious psychological condition - particularly if you have some additional physical limitation(s) - you may qualify for SSD from Social Security should you no longer be able to work your new position.
Good Luck.
