Legal Question in Medical Leave in Pennsylvania

harassment by human resources and supervisors,denying LOAs for medical reasons

what are our rights when it comes to supplying documentation for medical leaves and they are continually denied.? Also are they allowed to tell me that I am not allowed to get FMLA for my stepson who has mental and emotional issues which we were under the care of several Drs. therapists and the like?

I feel they are harrassing my family by telling us what & how we are to take care of our children, as well as DEMANDING very specific information regarding call offs for medical reasons. All have documentation and MOST have been denied. They are continually threatening to fire us and we are not the only folks they have done this to.

You asked about FMLA leave.

Employers has certain rights to demand minimal documentation and to approve or deny leave as appropriate. Employees have rights guaranteed by statute where they are qualified for such leave.

If an employee is improperly denied FMLA leave or policies are not open and fairly implemented and enforced then the employee may sue to enforce those rights. If the employee prevails they may be able to have the employer pay their legal fees.
