Legal Question in Medical Leave in Pennsylvania

Length of FMLA in PA

My sister is employed in Pa and had surgery several weeks ago. She is currently on FML which is due to expire (after 12 weeks)on June 16. Her Doctor will not release her to go back to work full time and her employer will not allow her to work part time. Is there any recourse? Is Pa FMLA any longer than the Federal Act?

The Family Medical Leave Act is a federal act. In general it allows for 12 weeks of leave for medical purposes. I believe that if your sister does not return to work at the end of the leave, her employer does nto have to give a a similar job with similar pay.
