Legal Question in Medical Leave in Pennsylvania

Posting the Documentation for FMLA

I am an Airline Employee. I work at a major Hub. As of this date 2/8/98, there is NO documentation anywhere on our bulletin boards or enclosed glass cases at work. Is this a violation of the Airline? And if so, what kind of action can I take so that this information is available for me and my fellow co-workers. Currently I am covered under the FMLA agreement. This airline does employ thousands! Please help.

Posting Notice of FMLA Rights

The regulations to the Family Medical Leave Act, at Section 825.300, require that an employer covered under the Act post a notice explaining the provisions of the Act in a prominent place. That same regulation provides for the assessmenet of a penalty of $100 for each separate offense, if the employer wilfully violates this requirement. It also prevents the employer from taking action against an employee who fails to give notice of a need to take FMLA leave, if the employer has failed to post the required FMLA notice. You may contact the Wage-Hour Division of the U.S. Department of Labor in your area to determine whether your employer is in compliance (assuming some form of notice is posted). That division also is responsible for enforcement of the FMLA, and can enforce the posting requirements.
