Legal Question in Medical Leave in Pennsylvania

Rights related to pregnancy in a small business setting

I work for a company that employees only 5 regular full time employees. Judging by comments made and treatment I've received, my employers are unhappy with my pregnancy. I am due in one month and would like to find out what benefits and rights I am entitled to since I assume my company is too small to have to adhere to the FMLA. Do they have to continue paying my health insurance premeium while I am out for 6 weeks after the baby is born? Am I entitled to the same position six weeks after the baby is born?

Pregnancy leave - Small business in Pennsylvania

The FMLA does not apply to businesses which employ only 5 persons, as stated in this question. You should consult a Pennsylvania attorney, however, to determine whether your state provides for some type of leave as a matter of law. Civil rights laws for Pennsylvania also might cover these issues. You must consult a local attorney to discuss all relevant aspects of your employment, so that you can determine what rights you have, if any.
