Legal Question in Medical Leave in Pennsylvania

Vacation Hoilday's and Sick time

I found out that at the tender age of 39 I was going to be blessed to have my first and only child. So then I decided that I would like to save all of my vacation time and use the holiday's that I would accrue and sick time to take at the end of the year. Then go right into my Maternity Leave. I was told that I could not use my holiday's first then two weeks vacation and any sick time that I have before I went into the Leave of Absence. So I'm now forced to loose my time and they want to combine all the time together. What can I do. I went out at the end of the year. Can You help me?

Re: Vacation Hoilday's and Sick time

There is very little law about how employers must apply earned and accrued time. You must go back to your employer's documents to see how you may use the accrued time. The employer also has great leeway on how to apply the FMLA leave policy. As long as it applies it evenly then there's little one can do if one doesn't like the policy.

Hope this helps.
